The -40 group of the Spanish and Ibero-American Arbitration Club (CEIA), in collaboration with Alessandri Attorneys at Law and FK Economics, convened in its first meeting in Santiago a group of arbitration experts who debated the effects and mandatory nature of staggered clauses. The event titled “The elephant in the room: effects and mandatory nature of escalating clauses” took place on Thursday, May 2nd, at the offices of Alessandri Attorneys at Law.
The panel was composed of lawyers Mónica van der Schraft (Garrigues), Diego Navarrete (Ortuzar, Vergara, Boetsch) and Liat Tapia (Ugarte & Correa), moderated by Patricio Rámila, partner of Alessandri and -40 delegate of the Chilean chapter of the CEIA .
In the discussion, various topics linked to tiered clauses were discussed, such as their main characteristics, their typology and conceptual nature, sanctions for non-compliance (jurisdiction or admissibility?), to conclude by commenting on the local reality and some practical advice for the drafting of this type of clauses.
