The privacy and confidentiality of personal data are fundamental aspects for ALESSANDRI ABOGADOS. This data protection policy outlines the processing of personal data for applicants in the recruitment and selection processes carried out by ALESSANDRI ABOGADOS for any company position.

For the purposes of this policy, the following terms shall have the definitions indicated below or the definitions established by the Privacy Protection Law or any rules that may replace it in the future.

   4. Data Processor: An individual or legal entity who processes personal data on behalf of the data controller as a result of a legal relationship linking them to the controller.
   5. Data Controller: An individual or legal entity, private or public, who decides on the data processing, meaning who makes decisions on what to do with the data from its collection to its deletion. Therefore, Alessandri Abogados is the data controller for applicants’ data in the recruitment and selection processes.
   6. Data Subject: An individual whose personal data is processed and for which Alessandri Abogados is responsible. In this case, the data subjects are the applicants in the recruitment and selection processes.
   7. Data Processing: Any operation or set of operations or technical procedures, automated or not, that allow the collection, storage, recording, organization, elaboration, selection, extraction, comparison, interconnection, dissociation, communication, transfer, transmission, or cancellation of personal data, or use it in any other way.

3. Lawfulness of Data Processing

The processing of personal data of applicants by Alessandri Abogados is based on the express and informed consent of the data subject and/or on the law, as applicable.

 

4. Data Collected

For the recruitment and selection process, Alessandri Abogados will collect personal data from applicants, including identification data such as: name, surname, ID number, address, phone numbers, email; academic background and professional experience; psychological and competence data based on the tests applicants undergo; data from publicly accessible sources; those necessary for background checks according to Alessandri Abogados’ compliance models and all data necessary to verify the suitability of the applicant for the position.

Alessandri Abogados does not control the legality of the information provided by applicants, therefore, it is not responsible for any infringement derived from the illegality, inaccuracy, illegitimacy, alteration, misuse, fraud, or sanction resulting from the information provided. Therefore, every applicant providing their personal data declares and guarantees that the data is accurate, truthful, and their own, that they have not impersonated others’ identities and/or that it does not belong to third parties.

 

5. Purpose of Data Processing

For carrying out recruitment and selection processes, Alessandri Abogados processes the personal data of job applicants for the following purposes:

1. 1. For personnel selection in the processes that Alessandri Abogados maintains open.
   2. Alessandri Abogados will keep a file with the information of applicants from recruitment and selection processes, to be considered in future recruitment and selection processes.
   3. To send communications to applicants to inform them about ongoing recruitment processes, request updates to their information, and provide information related to job offers at Alessandri Abogados.

 

6. Data Retention Period

The personal and sensitive data of applicants in the selection processes, specifically for those not selected and hired by the company, will be retained for the necessary period to fulfill the purposes described in this document. For those who are hired, the data retention period will be determined according to the data protection clauses applicable to employees in the relevant document.

 

7. Data Sharing

Alessandri Abogados will not share the personal data of the data subject with third parties, except when there is a legal mandate allowing it and in cases where the data subject expressly consents. By accepting this privacy policy, the data subject expressly authorizes Alessandri Abogados to share their personal data with third-party providers related exclusively to the recruitment and selection process. Such providers access personal data as Data Processors, meaning they process data on behalf of Alessandri Abogados.

 

8. Data Subjects’ Rights

Everyone has the right to obtain information about what data of their person is being processed. In this sense, any applicant can exercise the following rights before Alessandri Abogados:

1. 1. Request information on the personal data being processed.
   2. Rectify inaccurate, erroneous, ambiguous, or incomplete data.
   3. Cancel data processing.
   4. The data subject may request data blocking when they have voluntarily provided their personal data and no longer wish to remain in the relevant register, either permanently or temporarily.

Deletion or blocking will not proceed when there is a legal mandate obliging the data controller to process the personal data.

To keep data updated, we ask applicants to inform us of any changes or modifications affecting them by contacting postulaciones@alessandri.cl.

To exercise these rights, the data subject must contact Alessandri Abogados at alessandri@alessandri.cl. Upon request of these rights, Alessandri Abogados will verify the identity of the requester and may request all the necessary information, protecting the applicants’ personal data. Furthermore, if the requester’s identity cannot be verified, Alessandri Abogados reserves the right not to process the request.

Alessandri Abogados maintains appropriate security levels to safeguard personal data, aiming to prevent the loss, misuse, alteration, unauthorized access, and/or use of applicants’ data.
