/ Official examination fees are updated and readjusted

As of January 21, 2018, a readjustment of the official examination fees will come into force, implying an increase of around 9% of the current official examination fees for applications related to invention patents, utility models, industrial designs and drawings, schemes for plotting or topographies of integrated circuits. This readjustment is a consequence of the variation experienced by the Consumer Price Index (IPC), reported by the National Institute of Statistics.

On the other hand, the rules for the payment of the official examination fees have been also updated, so that:

  • The reimbursement of those fees will proceed, provided that the examiner has not been appointed yet and the applicant submits a formal withdrawal request.
  • In the case of invalidations or cancellation actions of registrations, the official examination fees will correspond to the double of the official “rate” corresponding to the substantive examination of applications for invention patents, utility models, industrial drawings and designs, schemes for plotting or topographies of integrated circuits.
