On Thursday, June 23, 2022 at 4 p.m., our firm organized the webinar “Update on personal data protection” to inform clients and interested parties on developments in this area. The virtual event had a high attendance of more than eighty people and was presented by Macarena Gatica, our partner expert in technology, cybersecurity and personal data.

Art. 15 bis of the Pro-Consumer Law 21,398, which grants Sernac the competence to supervise and watch over consumers’ personal data, was discussed. Therefore, it is restricted to a consumer relationship.

“The provisions contained in Articles 2 bis paragraph b), 58 and 58 bis will be applicable with respect to consumers’ personal data, within the framework of consumer relations, unless the powers contained in said articles are within the scope of the legal competences of another body.”

In addition, Macarena presented on class actions, the interpretative circular letter on the protection of consumers against the use of AI systems in consumer relations and the interpretative circular letter on fairness criteria in the provisions contained in standard-form agreements referring to the collection and processing of consumers’ personal data.

Our partner also commented on the novelties regarding bill 11,144 on personal data protection. In 2021, by indication of the executive branch, the CPLT was replaced by the Data Protection Agency. This 2022, it stands out:

  • Second constitutional stage.
  • Constitutional Committee.
  • Presentation of indications.
  • Active participation of Minister Giorgio Jackson.

The talk also discussed abusive clauses, risk management and Macarena gave different recommendations on how to treat and protect the clients and collaborators data correctly.
