/ Preparation and drafting of a crime prevention model referred to in law No. 20,393 on criminal liability of legal entities
Since the entry into force of the Criminal Liability Law for Legal Entities at the end of 2009, which regulated the possibility of these being directly liable for certain crimes, it has become imperative for every company to prepare and draft a crime prevention model, which not only puts companies in a better position to face the commission of a possible crime and the eventual criminal prosecution, but also favors the management of legal and reputational risks of the company.
The preparation of these models necessarily implies a commitment of the company’s top management and a permanent control and dissemination of the compliance plan within the company, especially to the board of directors and executive officers as well as to the rest of the workers.
