Alessandri & Compañía Abogados’ technology and data protection practice regularly draws upon the specialisms of the firm’s IP, corporate law, finance, litigation, tax, and labour law departments. The team’s broad industry expertise ranges from healthcare, banking, insurance, retail, and food and beverages, to fintech, real estate, software and media, among others. The group routinely advises both Chilean bank Banco de Crédito e Inversiones and healthcare software platform Healthatom on data privacy matters, while its recent experience extends to participating in CMF roundtable discussions on varying data privacy standards. Practice head Macarena Gatica (re-elected in November 2023 for a second term as director of AmCham, which promotes business development between Chile and the US), is routinely invited by Chile’s National Congress to participate in discussions on bills concerning data protection, cybersecurity and technology; and IT and IP-focused managing partner Rodrigo Velasco A is a specialist in technology, media and IP matters. In the associate ranks, María Ignacia Ormeño regularly acts for companies on the implementation of personal data protection programmes, technology contracting and cybersecurity, including the drafting of privacy and cookie policies; and Jaime Urzúa‘s personal-data protection practice covers the financial, insurance, health, retail and technology industries.

2. Intellectual Property – Band 2

The 13-strong multidisciplinary IP practice at Alessandri & Compañía Abogados fields engineers, chemists, biotechnologists and designers, in addition to lawyers. The team is highly experienced in obtaining protection for innovation, both at domestic and foreign levels; and it is particularly active in relation to the evaluation of potential patents of university projects. Recent highlights include acting for retailer Michael Kors International (Switzerland) in a trade mark infringement-related nullity action; and assisting Uber Technologies with its opposition to a trade mark application for cosmetic products. The department is co-led by music industry specialist Rodrigo Velasco A, who routinely advises on the licensing contractual, taxation and litigious aspects of domain names, trade marks, patents, data protection, software and the internet; and Santiago Ortúzar, who focuses on the protection of innovation and patents, as well as contracts and defence-side free competition cases. Ortúzar is also notably experienced in designing strategies for the global protection and licensing of the innovation and patents of Chilean companies, universities and inventors. At director level, Carla Pacheco advises on portfolio management, advertising and unfair competition, along with litigation and the management of portfolios abroad. Alessandri & Compañía Abogados’ consumer team is particularly focused on legal and regulatory compliance work, including the establishment of crime prevention models that encompass prevention, management, control and reaction mechanisms. It also assists with claims before SERNAC, collective procedures, privacy policies, and e-commerce-related online sales. Co-heading the firm’s intellectual and industrial property group, Santiago Ortúzar assists with the application of the Consumer Protection Law, while Macarena Gatica leads the TMT and data protection teams. At senior associate level, Luis Fuentes focuses on civil and commercial litigation, as well as administrative sanctioning procedures.

Particularly well known for its IP expertise, Alessandri & Compañía Abogados’ multidisciplinary team fields experienced lawyers, engineers, chemists, biotechnologists and designers, who specialise in processing life sciences-related IP applications. The group also advises on freedom-to-operate issues, prior art evaluations and invention patent drafting. Co-leading the firm’s intellectual and industrial property team, Santiago Ortúzar predominantly advises on patents, contracts and defence-side competition cases; and managing partner of the technology and IP departments, Rodrigo Velasco A, specialises in the licensing, contractual, tax and litigation aspects of domain names, trade marks, patents, data protection and software.

5. Banking and Finance – Band 4
The banking and finance team at Alessandri & Compañía Abogados assists financial institutions, borrowers and underwriters with both cross-border and domestic transactions. The department includes experts in credit transactions governed by US laws; and it has notable experience in real estate and movable collateral packages under Chilean law. The practice is led by banking law and corporate finance specialist Fernando Jamarne, who is experienced in public bids, bond issuances, syndicated loans, private issues, and loan contracts. Promoted to partner in March 2023, José Cuadra’s broad practice includes foreign investment, M&A, and corporate finance with financial institutions and multilateral entities. At associate level, semi-senior Hans Kokott is currently completing his LLM in finance, while intermediate Vicente Guíñez assists with banking matters (particularly syndicated loans) and fintech.

6. Corporate and M&A – Band 4
The full-service corporate and M&A practice at Alessandri & Compañía Abogados covers share, asset purchase, shareholder and transitional services agreements, its assistance including legal, tax and environmental due diligence aspects. The group also advises multinationals and private equity firms on acquisitions, sales, day-to-day transactions, deal structuring and compliance with local regulations. Co-leading the department, Fernando Jamarne specialises in commercial and financial transactions, while Felipe Cousiño is particularly experienced in international deals. Providing notable support, both José Antonio Cuadra (raised to the partnership in March 2023), and firm managing partner Arturo Alessandri C focus on foreign investments and M&A; while associates Francisca Donoso, Vicente Guíñez and Yu Ling Lay He all advise on a range of corporate matters.

The six-strong dispute resolution practice at Alessandri & Compañía Abogados is experienced in civil and commercial disputes concerning technology, capital markets, insurance, construction, transport, and manufacturing. The team is also particularly well known for its IP disputes credentials, defence-side administrative claims, and product liability, misleading advertising and class actions. The group is led by Raúl Montero, who acts in disputes over civil liability, construction, telecoms, unfair competition, IP and consumer protection. The practice further includes Patricio Rámila, who is experienced in civil and commercial disputes, as well as domestic and international arbitrations; and in the associate team, senior Luis Fuentes, Bruno Orrego and Rosario Quinteros all act in civil and commercial litigation.
