/ Patent term adjustment for pharmaceuticals in Latin America: A special reference to the case of Chile.

Francesca Rodríguez, senior associate, publishes an article in the 2018 AIPLA Chemical Practice Committee Newsletter, about the ongoing discussion based of the patent term adjustment processes for pharmaceuticals in Chile.

 

In Colombia, Chile and Peru, compensation for patent right holders for the unjustified or irrational delays experienced during the prosecution of their patent applications may be available as a by-product of the Free Trade Agreements (FTAs) signed with the European Union and the United States. The effective application of the patent term adjustment for pharmaceutical patents in these Latin American countries has been subject of interesting discussions and official studies.
