As of December 31, 2020, trademarks already registered in the EU – and EU designations – will be automatically “cloned” in UK registrations or designations. The same with international brands with designation in the EU.

However, and in the case of pending trademark applications, there will be a nine month period that expires on September 30, 2021, to request cloning. In cases of pending applications then, the cloning will not proceed automatically, so the action of the applicants will be required.

If you have a registered trademark or a pending application owner in the EU and you have any questions regarding the field of protection, or interest in registering a trademark in the EU and / or the UK, do not hesitate in contacting us.
