Revolucionario invento chileno obtiene patente
Un importante logro obtuvo la empresa chilena TCPavements, cuyo accionistas son el dueño de Sonda, Andrés Navarro y Juan Pablo Covarrubias, inventor de la idea, al obtener recientemente la concesión de una patente sobre un método de construcción de losas para pavimentos, que prolonga su vida útil y reduce significativamente los costos de inversión (construcción y mantenimiento). El Laboratorio Nacional de Vialidad del MOP está incorporando esta tecnología al manual de carretera del Ministerio y ése ha utilizado en Chile, Perú y Guatemala. Esta tecnología, además, ha sido patentada en EE.UU, Sudáfrica, y está en solicitud en más de 80 países. La patente fue tramitada por Alessandri & Compañía Abogados.
Sobre la patente
La solicitud chilena de patente fue presentada en 2005 ante el Instituto Nacional de Propiedad Industrial y luego de cumplir con todos los exámenes e informes periciales establecidos legalmente fue finalmente concedida por un plazo de vigencia de 15 años, con expiración en el año 2024. En cuanto a su alcance, el derecho de exclusividad conferido a Inversiones Yuste S.A. protege tanto el método de fabricación como las losas obtenidas mediante el mismo.
La concesión de dicha patente es coetánea con la aplicación del Tratado de Cooperación en materia de Patentes (conocido como PCT por su sigla en inglés), cuya vigencia comenzó el 2 de junio en nuestro país, luego de haber sido aprobado por el Congreso Nacional y ratificado ante la Organización Mundial de la Propiedad Intelectual. El Tratado PCT establece un sistema de tramitación internacional de solicitudes de patentes de invención con vigencia en prácticamente la totalidad de los países del mundo.
Conjuntamente con la solicitud de patente nacional, la empresa solicitante tramitó en paralelo una solicitud internacional PCT sobre la misma invención, en una época en que dicho tratado aún no tenía vigencia en nuestro país. Con anterioridad a la decisión adoptada por el Instituto Nacional de Propiedad Industrial, la solicitud internacional PCT sobre esta invención había sido objeto de un informe favorable de patentabilidad realizado por la Oficina Europea de Patentes (EPO), lo que permitió a la firma chilena iniciar los trámites para proteger la invención en numerosos países a lo largo de los cinco continentes, incluyendo Estados Unidos, en el que la patente también fue concedida. El abogado a cargo de la tramitación de la patente en nuestro país, Rodrigo Velasco Alessandri, socio de Alessandri & Compañía, explica: "Es todo un ejemplo a seguir, considerando las dificultades que deben sortear las innovaciones en Chile para ser reconocidas como derechos exclusivos. Ahora contarán con una vía mucho más expedita para validar sus patentes de invención a nivel mundial."

Revolutionary Chilean invention obtains patent
A significant achievement was recently realized by the TCPavements Chilean corporation, whose shareholders are Andrés Navarro, the Sonda company owner, and Juan Pablo Covarrubias, who invented the idea, when it was granted a patent for invention concerning a method to build pavement slabs, which extends their service life with a great reduction in investment costs (construction and maintenance). The National Highway Laboratory at the [Chilean] Ministry of Public Works (MOP) is currently incorporating this technology to the Ministry's Highway Manual and it has already been used in Chile, Peru and Guatemala. In addition, this technology has already been patented in the USA and South Africa while patent applications for the same have been filed in more than 80 countries. The patenting process was the responsibility of Alessandri & Compañía Abogados.
The patent
The Chilean patent application was filed in 2005 at the National Institute of Industrial Property and upon completing all the statutory exams and experts' reports it was finally granted for a 15 year term expiring in the year 2024. With relation to its scope, the exclusivity right granted to Inversiones Yuste S.A. protects both the manufacturing method and the slabs obtained with the same.
The concession of said patent is contemporary with the application of the Patent Cooperation Treaty (PCT), effective in our country since June 2, 2009 upon its congressional approval and ratification before the World Intellectual Property Organization (WIPO). The PCT Treaty establishes an international scheme for patent application processing, effective in practically every country in the world.
In unison with the Chilean patent application filing, the applicant company submitted an international PCT patent application for the same invention, at a time when said treaty was still not applicable in our country. Prior to the decision adopted by the National Institute of Industrial Property, the international PCT patent application for this invention had received a favorable patentability report from the European Patent Office (EPO), enabling the Chilean firm to initiate the proceedings to protect its invention in numerous countries in all five continents, including the United States of America, where the patent was also granted.
